Overview
Steelay ("Steelay," "we," "us," or "our") provides a digital platform that enables users to document, manage, and optionally share personal hair styling history, including images, notes, and related data (the "Services").
Steelay is a software platform only and does not provide salon, cosmetic, or professional hair services.
By accessing or using the Services, you agree to be bound by these Terms of Service ("Terms").
Eligibility
You must be at least thirteen (13) years of age to use the Services.
If you are under eighteen (18), you represent that you have permission from a parent or legal guardian.
Steelay does not knowingly permit use by children under 13.
Accounts
You agree to:
- Provide accurate and complete information
- Maintain the security of your account
- Be responsible for all activity under your account
Steelay may suspend or terminate accounts that violate these Terms.
SMS Communications and Verification
By providing your phone number, you consent to receive transactional SMS messages for account verification and security purposes.
- Message frequency is limited to account-related use
- Message and data rates may apply
- Consent is not a condition of purchase
Steelay does not use SMS for marketing without separate consent.
User Roles
The Services are designed for:
Clients (Users) — Individuals documenting, maintaining, and accessing their personal Style Passport.
Stylists (Professionals) — Individuals documenting services, maintaining client records, recording styling-related information, and managing professional portfolios.
Stylists may create client records before a client creates a Steelay account. If the client later registers and verifies ownership of the corresponding phone number, the associated Style Passport may be linked to that client's account.
User Content and Ownership
You retain all rights in and to any content you upload or create through the Services ("User Content"), including photographs, videos, notes, hair profiles, formulas, service history, and related styling information.
You grant Steelay a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display User Content solely for the purpose of operating and improving the Services.
Data License and De-Identified Information
Steelay may collect, generate, and use aggregated and de-identified data derived from user activity, content, service locations, and general geographic information.
Such data:
- Cannot reasonably identify an individual or specific business
- Is processed to prevent linkage to any specific user or stylist
- Is maintained using commercially reasonable safeguards
Steelay may use, analyze, commercialize, license, publish, disclose, and otherwise exploit Aggregated and De-Identified Data for any lawful purpose, including analytics, benchmarking, research, product development, commercial partnerships, market insights, and industry reporting.
Aggregated and De-Identified Data, derivative analytics, statistical models, benchmarking information, trend analyses, machine learning models, and other insights derived from the Services shall not constitute User Content and shall remain the exclusive property of Steelay. Steelay does not attempt to re-identify such data.
Derived Data and Insights
Steelay may create derivative data, models, and insights based on User Content, provided such outputs do not contain identifiable information. All such derivative works are the exclusive property of Steelay.
Privacy and Visibility Controls
All User Content is private by default.
Media and styling information uploaded by a stylist may be visible to the client associated with that Style Passport after the client successfully verifies ownership of the corresponding account.
Users and stylists control whether eligible content is shared through public platform features.
Where public sharing is available, Steelay is designed to minimize the disclosure of personal information. Publicly shared content may include media, styling information, and service location information, but generally will not intentionally display direct personal identifiers such as names, email addresses, or phone numbers unless expressly authorized by the applicable user.
Professional Content and Confidentiality
Hair color formulas, techniques, and professional notes submitted by stylists ("Professional Content") are confidential and private by default.
Steelay will not disclose Professional Content in identifiable form without the stylist's explicit authorization. No user is granted rights to reproduce or use Professional Content beyond what is explicitly shared by the stylist.
Nothing in these Terms grants Steelay ownership of a stylist's proprietary formulas or techniques, except as necessary to operate the Services and generate Aggregated and De-Identified Data as described herein.
Style Passport Ownership and Client Records
A Style Passport is a digital record maintained through the Services that may contain photographs, videos, styling notes, formulas, service history, salon information, and related styling information.
A stylist may create and maintain a Style Passport on behalf of a client before that client creates a Steelay account.
Upon successful account verification using the corresponding phone number, the client may claim and access the associated Style Passport, subject to applicable access controls and permissions.
Nothing in these Terms requires a stylist to disclose proprietary Professional Content beyond what the stylist chooses to share through the Services.
Acceptable Use
You agree not to:
- Copy or exploit content from other users
- Scrape or extract data from the platform
- Impersonate any individual or business
- Upload unlawful or infringing content
- Use the platform for unauthorized commercial purposes
You may not attempt to reverse engineer, infer, reconstruct, or identify any individual or business from Aggregated and De-Identified Data made available through the Services.
Prohibited Data Extraction
You may not:
- Use automated tools to collect platform data
- Compile or repurpose user content
- Extract data for commercial use
Violations may result in account termination and legal action.
Third-Party Services
The Services may integrate with third-party providers, including cloud hosting providers, analytics providers, mapping services (such as Google Maps), messaging providers (such as SMS verification providers), authentication providers, and other infrastructure necessary to operate the Services.
Use of third-party services remains subject to their respective terms and privacy policies.
Physical Services Disclaimer
Steelay is a digital record-keeping and sharing platform only.
Steelay is not responsible for:
- Haircuts, coloring, or treatments
- Results of any salon services
- Interactions or disputes between users and stylists
All physical services are performed independently by third parties.
Platform Rights
Steelay may:
- Remove, restrict, or modify content that violates these Terms.
- Suspend or terminate accounts.
- Modify, discontinue, replace, or improve any feature or functionality of the Services.
- Introduce new features, products, subscription plans, or commercial offerings.
- Use Aggregated and De-Identified Data to improve existing Services and develop future products.
Termination
You may terminate your account at any time by contacting hello@steelay.style or using the in-app account deletion feature.
Steelay may suspend or terminate access for violations of these Terms. Upon termination, your right to use the Services ceases immediately.
Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, Steelay shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Paid users: Steelay's total liability is limited to amounts paid in the prior 12 months
- Free users: Steelay's total liability is limited to zero dollars (USD $0)
Indemnification
You agree to indemnify, defend, and hold harmless Steelay and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your User Content, or your violation of these Terms.
Dispute Resolution and Arbitration
Any dispute arising from these Terms or the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Miami Dade, Florida.
You waive the right to:
- Participate in class actions or class arbitrations
- Seek relief in court, except for small claims matters
You may opt out of arbitration within 30 days of first accepting these Terms by emailing hello@steelay.style with "Arbitration Opt-Out" in the subject line.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
Apple App Store Terms
If you access Steelay through an Apple device:
- Apple Inc. is not a party to these Terms and is not responsible for the Services
- Apple has no obligation to provide maintenance or support for the Services
- Apple is a third-party beneficiary of these Terms and may enforce them against you
Google Play Store Terms
If you access Steelay through a Google Play device:
- Google LLC is not a party to these Terms and is not responsible for the Services
- Google has no obligation to provide maintenance or support for the Services
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Steelay regarding the Services and supersede all prior agreements.
Changes to Terms
Steelay may update these Terms periodically. For material changes, we will notify you via email or in-app notice prior to the change taking effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
